The 2006 Hong Kong Shopping Festival (HKSF) Lucky Draw (Lucky Draw) organised by the Hong Kong Tourism Board (HKTB) runs from 24 June to 31 August 2006.

Winners will be drawn on 7 September 2006 from the Lucky Draw entries registered during the above-mentioned period at the HKTB Head Office, situated at Citicorp Centre, 18 Whitfield Road, North Point, Hong Kong (or such other venue as may be determined and announced by the HKTB).

The Lucky Draw is open to Hong Kong residents holding a valid Hong Kong Identity Card and all bona fide visitors holding valid travel documents. Participants must be aged at least 18 before the end of the promotion on 31 August 2006.

Employees of the HKTB, and advertising, promotion and fulfilment agencies of the HKTB and their respective immediate family members are not eligible to enter the Lucky Draw.

Participants who make purchase of HK$300 or above in one single transaction (as recorded on a single receipt) at a participating merchant (any shop, restaurant or department store displaying the 2006 Hong Kong Shopping Festival participating merchant sign) during the promotional period are entitled to participate in the Lucky Draw. Participants will receive one Lucky Draw entry for every HK$300 spending of each single transaction. The total spending shown on an individual receipt must be at least HK$300. Accumulation of receipts to come up with a total spending of HK$300 will not be accepted. Credit card slips, bank statements, delivery notes and computer-generated slips for on-line purchases will not be accepted for Lucky Draw registration or prize redemption.

The number of Lucky Draw entries earned is calculated on the price of goods and services paid for after deducting all discounts. Spending excludes adding value to an Octopus Card, payments for telecommunication services, IDD, internet, cable TV, mobile phone calls and data charges, gas supply and any other utilities charges of similar nature. For instalment payments, the spending will only be counted if the related contract is signed and committed within the promotional period.

Participants can register Lucky Draw entries by presenting original receipts at any HKSF Lucky Draw Counter. Receipts must be stamped with the HKSF participating merchant chop for registration of the Lucky Draw entry. The cut-off date and time for registration is 31 August 2006 10:30 pm or the closing time of individual Lucky Draw Counter, whichever is earlier .

Upon completion of the registration, participants will be given a Registration Slip stamped with the HKSF Lucky Draw Chop, showing the date and time of registration, the purchase date and spending amount of the receipts registered, and the number of Lucky Draw entries entitled. Participants should examine details shown on the Registration Slip and report any discrepancies on the spot. Late reports will not be entertained.

Participants can enter the Lucky Draw as many times as they wish. Each participant may win more than one prize.

Results of the Lucky Draw will be posted on the DiscoverHongKong.com web site between 12 September 2006 and 13 November 2006 and published in the Sing Tao Daily and The Standard newspapers on 14 September 2006.

Winners must contact the HKTB for registration on or before 13 October 2006. Any winners failing to contact the HKTB by this date will forfeit their prizes.

To claim a prize, a winner must present his / her Hong Kong Identity Card or travel document, the Registration Slip showing the winning registration number and the corresponding original receipt together with the original redemption letter issued by the HKTB. Credit card slips, bank statements, delivery notes and computer-generated slips for on-line purchases will not be accepted for prize redemption.

By entering into the Lucky Draw, participants accept and agree to be bound by the Lucky Draw terms and conditions and the terms and conditions attached to the prizes. The HKTB reserves the right to withhold the prize or reclaim the prize if awarded, and award or dispose of it in such manner and to such person as the HKTB deems fit if the winner is subsequently disqualified or is found not to be entitled to participate in the Lucky Draw.

Winners who fail to redeem or claim their prizes before the deadline designated by the HKTB and respective prize sponsors will be considered as having given up their right to redeem or claim their prizes.

Any winner, whose prize (or prize entitlement) has been forfeited, is not entitled to any payment or compensation from the HKTB or respective prize sponsors. The HKTB reserves the right to award or dispose of the forfeited prizes in such manner and to such person as it deems fit.

The HKTB reserves the right to disclose and publish the names and such other particulars of the winners or their representatives where applicable (including photographs), in such mode and manner as the HKTB may in its sole discretion deem appropriate for publicity purposes (including publicity after the Lucky Draw). Participants, by entering into the Lucky Draw, consent (and should procure consent from their representatives where applicable) to such disclosure and publication, and agree to co-operate with and participate in the activities, including the Lucky Draw prize presentation ceremony (if any) and other related promotional and advertising activities, organised by the HKTB for this purpose.

Winners are responsible for arranging for transport, delivery, customs clearance and insurance of their own prizes and all taxes, charges and fees in relation thereto.

The HKTB may, at its sole discretion and without consultation or reference to Lucky Draw participants, at any time substitute or replace any prize with any other prizes of equal or similar value at the choice of the HKTB.

The decision of the HKTB on all matters relating to, or in connection with, the Lucky Draw shall be final and binding on all parties concerned. Other than as stated in these terms and conditions, the HKTB shall not be obliged to contact the participants or any other person, or consider any appeal by or enter into any correspondence with any participants or any other person on any matter concerning the Lucky Draw.

Any violation by the participants of these terms and conditions will result in disqualification of the relevant participants.

The copyright of the material, text, graphics, logos and images on any promotional materials of the Lucky Draw belong to the HKTB solely and exclusively. The contents on the promotional materials of the Lucky Draw may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any other purposes not expressly permitted by the HKTB.

The invalidity, illegality or unenforceability of any provision in these terms and conditions shall not affect the other provisions of these terms and conditions, which shall remain in full force and effect.

These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region, and the Hong Kong Courts shall have the exclusive jurisdiction to deal with all matters relating to these terms and conditions.

The HKTB reserves the right to suspend, amend or modify any of these terms and conditions, and any arrangements in connection with the Lucky Draw, and may withdraw or discontinue the Lucky Draw at any time at its sole discretion, and without prior notice or liability.

The HKTB shall not be liable in any way to any person for any loss or damage (whether direct or otherwise) arising from or in connection with the Lucky Draw, including but not limited to any error or omission in conducting the draws, loss or destruction of Lucky Draw entries or other property or belonging, or any notice or correspondence which is misdirected, mislabelled, delayed or lost in the post or otherwise.

The HKTB shall not be liable in any way to any person (whether by way of indemnity or contribution or otherwise) for any claim whatsoever arising from or in connection with the Lucky Draw whether for property damage, personal injury or death or of any other nature whether or not the same is caused by the act, omission or negligence of the HKTB.

The HKTB is not a supplier of participating merchant's products and services or the prizes and will not accept any liability (whether for property damage, personal injury or death or of any other nature) thereof or in connection thereto. In the event of any disputes arising from the participating merchant's products and services or the prizes, the decision of the HKTB and the related participating merchant or prize sponsor shall be final and binding on all parties concerned.

The HKTB and the prize sponsors (and their respective employees, directors, officers, agents and assigns) shall not be responsible or liable for the lost, late, mechanically duplicated, illegible, incomplete, mutilated, tampered with, corrupted or misdirected entries, entries not received in time for the draws, or for incomplete, lost, late, damaged, illegible, incomplete, mutilated, tampered with, corrupted or misdirected transmission, or for any kind of problems (technical or otherwise) with, failure or malfunction of any telephone network and/or transmission line, computer systems or equipment, servers, providers, hardware or software, or for any lost or unavailable network connections, or for failed, incomplete, garbled or delayed computer data/ transmission, or any combination thereof which may prevent or limit one's ability to participate in the Lucky Draw, save and except for those attributable to the wilful default or gross negligence of the HKTB and the prize sponsors.

If for any reason, the computer system in whole or in part is not capable of running, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Hong Kong Tourism Board, which corrupt or affect the administration, secrecy, fairness, integrity or proper conduct of the Lucky Draw, the HKTB reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and/or cancel, terminate, modify or suspend the Lucky Draw.
